Neighborhood planning process moving forward

Mike O’Brien’s Seattle Public Utilities and Neighborhoods Committee (SPUNC) approved Resolution 31204 Tuesday afternoon, moving forward to begin a year of public comment and other work toward finalizing the Neighborhood Plan Updates for North Beacon Hill, North Rainier, and Othello.  The full text of the resolution is available here. Council members charged the Department of Planning & Development (DPD) and Dept. of Neighborhoods (DoN) with “making everyone happy” by creating an implementation process and urban design guidelines.  The resolution calls for extensive community involvement, including continuing outreach to underserved communities.

DPD and DoN will also be offering the opportunity for interested parties to share ideas online.  The timeline calls for the development of Action Plans from April to August 2010. Work groups will begin forming to develop Urban Design Framework Plans from June to November 2010.

There is a public meeting scheduled on Friday, May 14 at Asa Mercer Middle School, 1600 South Columbian Way.  Childcare and translation services will be available. Further information about the meeting will be coming soon.

Eight Beacon Hill projects pursue Opportunity Fund grants

The North Beacon Hill Council Board is submitting a letter of support for eight groups submitting applications to build new parks or improve existing parks in Beacon Hill. The 40+ people attending last night’s NBHC meeting unanimously supported this motion. Presenters were succinct and provided an impressive amount of information about their respective projects.

The eight groups presented information about applications they are submitting to the Parks and Green Spaces Levy Opportunity Fund for parks in Beacon Hill.  You can find out more about the Opportunity Fund in their FAQ.

The Opportunity Fund is community-driven. A key aspect of the application is how much community support a project has.  If you would like to share comments, concerns, or enthusiastic support about a proposal, contact Seattle Parks and let them know what you think. Briefly, the eight proposals are:

  • Volunteers and community members seeking funding to continue efforts to improve Lewis Park, such as clearing invasive species, planting natives, and restoring the natural areas in the park’s ravines
  • Development of a Food Forest in Jefferson Park, including bicycle and walking paths, a community shade structure, and habitat renewal for beneficial insects and birds
  • Acquisition of land around the Beacon Hill Light Rail Station to develop a North Beacon Central Park
  • Walker Street Park and Orchard proposal to acquire 10 lots on the boundary of the North Beacon Hill and North Rainier Urban Villages
  • Beacon Hill Youth Soccer Association efforts to improve the youth soccer field adjacent to Beacon International School so that it can be used year-round, by replacing grass with artificial turf
  • El Centro de La Raza seeking to improve their playground and increase access to the public by upgrading play structure; adding landscaping, outdoor meeting space, green features, and cultural aspects; adding ADA accessibility; and improving the basketball court
  • Efforts to preserve and renovate the historic reservoir gatehouse building in Jefferson Park
  • Development of a viewpoint pocket park at 12th and Hill, including addition of a retaining wall, viewing platform, and seating area

11 of 13 issues dismissed from North Beacon Hill DNS appeal

The Hearing Examiner has dismissed all but two issues from the North Beacon Hill DNS appeal filed on January 29 by Frederica Merrell, stating that the dismissed issues are “broad, conclusory allegations unsupported by any stated facts,” and that they do not meet municipal code and Hearing Examiner requirements that issues raised in an appeal be clear, concise, and specific. Additionally, the ruling states that the issues “fail to give the Department and Intervenor fair notice of the claims being asserted.” Two of the issues were dismissed outright earlier this month, and nine more in a decision given on Monday.  The hearing will now address the two issues that remain.

The two remaining issues are:

#6: “The DPD failed to meaningfully consider the probable impacts of the future development that would be allowed by the proposed changes to the Comprehensive Plan and zoning.” The ruling states, “Although the appeal failed to specify the probable impacts being referred to, the Appellant stated in her response to the motions to dismiss that this issue is addressed to the impacts of additional density on public services.” With that clarification, the issue was deemed sufficiently specific to be considered.

#8: “The DPD did not use notice procedures that were reasonably calculated to provide notice to property owners and other affected and interested individuals, tribes, government agencies, businesses, school districts, and organizations of the proposed amendments to comprehensive plans.” This issue was also clarified by Merrell; the March 11 ruling states that “the Appellant clarifies that the notice issue concerns the changes, alleged to be substantive, that the Department made while consolidating goals and policies after public notice of the DNS.”

For a full explanation of the decision, read the Examiner’s ruling here.  The appeal is still scheduled to be heard on Monday, April 26, 9:00 am at the Seattle Municipal Tower, 700 5th Avenue.  The Othello appeal hearing has been rescheduled to May 24, and the North Rainier appeal was dismissed earlier this month.

BRIC applying for grant to create Walker Street Park

The Beacon Ridge Improvement Community (BRIC) is applying for a grant through the Opportunity Fund to acquire land for a park located at 17th Avenue South and South Walker Street. BRIC is responsible for such neighborhood success stories as the stair restoration projects on Holgate, Hill, and Walker Streets (winning two grants from the City) and organizing neighbors to address crime and public safety issues.

At the March North Beacon Hill Council meeting, BRIC members Andrew Abian and David Gackenbach presented a slideshow of their vision for a “pocket park” and orchard. They are hoping to generate community support for this idea, both to strengthen their Opportunity Fund application and to get the community excited about the potential for a new park on Beacon Hill. To share your opinions regarding this proposal, attend the North Beacon Hill Council meeting on Thursday, April 1 at 7:00 pm at the Beacon Hill Library. You can also visit the Parks Department comment page. All comments must be received by April 2.

The Opportunity Fund provides $15 million solely for community initiated park projects. Neighbors have the opportunity to propose a park development project and/or propose a piece of property for Parks to acquire.

BRIC’s Walker Street Project application requests approximately $1.0 million to acquire 10 lots (an entire block!) of land to be used as a play area, community orchard, and green space. The current owner lives in the only house on the block and seems open to the idea of the property becoming a park.

This location was chosen because it is relatively level and accessible from a part of the neighborhood where there are no other parks easy for families with young children to reach. It is also uniquely situated on the boundary between the North Beacon Hill Urban Village and the North Rainier Urban Village—potentially bridging the gap between green spaces in both communities. Preserving tree canopy and open space in this location will help bridge the gap in green spaces in two areas slated for increased development.

The Walker Street Project is one of several proposals being submitted from Beacon Hill. Beacon Hill community members are also applying for Opportunity Fund support for an urban farm in Jefferson Park and a Central Park near the Light Rail Station.

First ruling on neighborhood plan appeal released

Sue Tanner, the Hearing Examiner, has released her first ruling regarding the appeal Frederica Merrell filed last month against the Department of Planning and Development (DPD) regarding the Determination of Nonsignificance (DNS) of the North Beacon Hill neighborhood plan update process. Here is the full text of the ruling.

Tanner dismissed two issues in the appeal outright because they are outside the jurisdiction of the Hearing Examiner’s office (the issues were related to planning process).  She upheld one issue that DPD and El Centro de La Raza had requested to be dismissed, regarding whether DPD provided adequate notice for attendance at a meeting.

The revised schedule for the appeal is included in the document.  The final hearing on the appeal is currently scheduled for April 26 at 9:00 am.

Cienna Madrid at the Slog has reported on this as well, and notes that one of the other two nearly identical appeals filed last month, the North Rainier (Mount Baker) appeal, has been dismissed because the appellants did not respond to the motion to dismiss. The Othello appeal continues and is scheduled for May 24 at 9:00 am.

Walking with Tica: Growing community

When I was cruising the internet 10 years ago searching for the perfect canine companion, I looked forward to having a fuzzy head keep my feet warm on the couch and planned the cool tricks I would teach my new pal. I also started jogging a few weeks in advance, so that I would be in better shape to tire out an energetic young dog (ha!).  I researched food, off-leash areas, doggy daycares and dog walkers.

What I didn’t realize was that over the years, I would get to know every tree and front flower garden in the neighborhood.  I’ve learned where the dogs live and where the cats like to hide.  While Tica sniffs, I read the “for sale” and “lost bike” signs on the telephone poles.  We’ve watched babies grow into kindergardeners. Walking with Tica has shaped the way I interact with my community.

I enjoy casual (and sometimes lengthier) conversations with neighbors—mostly those who spend a lot of time outside, like the dog owners and avid gardeners. Walking with a dog provides an opening for conversation, sort of a secret handshake.  People stop and smile and start conversations.  People reach into their pockets (or go into their houses) to share a treat with Tica.  We exchange cookies during the holidays and keep an eye on each other’s homes on vacation.

It shouldn’t have surprised me that growing a baby brings out the same responses in people.  I’m getting to know an entirely different group of neighbors—the grandmas, the moms without dogs, older kids who feel safe making eye contact with a mom-to-be.  The always friendly library staff and Red Apple cashiers are absolutely bubbly.  People who usually walk quickly from their car to the front door linger on the sidewalk to say hello, ask how I’m doing, or offer baby items.  I’m amazed by the generosity of our neighborhood.  Thank you to all the neighbors who’ve shared baby items, support, and yummy snacks!

If you’d like to donate children’s items or know a family in need, Wellspring Family Services operates the Baby Boutique.   Their “urgent needs” wishlist includes: carseats, maternity clothes, shoes, and personal care items (shampoo, lotion, etc).  The Baby Boutique serves kids of all ages, from newborn to teenager.  Baby Boutique accepts donations on the following days and times: Tuesday 10:00 am – 7:00 pm; Wednesday thru Friday 10:00 am – 3:00 pm; 2nd and 4th Saturday of the month 10:00 am – 2:00 pm; or call 206-902-4270 to set up an appointment. Due to limited space, they cannot accept items larger than cribs or toddler beds.

I’m just getting started with the North Beacon Hill Parents yahoo group.  It seems to be a good place to give away/sell kid items and post questions about everything from preschools to replacing old wood windows. I’m looking forward to interacting more with this group.

Neighborhood planning with SPUNC

On Tuesday, March 9, the Seattle Public Utilities and Neighborhoods Committee (SPUNC) agenda included a review of the North Beacon Hill Neighborhood Plan update.  You can watch the committee meeting on the Seattle Channel website.

Some points of interest in Tuesday’s meeting:

(approx. 20 minute mark) Brief discussion of the goals of the presentation, including mention of the recent appeal of the plan update process, and how the appeal may affect Council actions on the plan (basically, the Department of Planning and Development advising the Council to honor whatever decision the Hearing Examiner makes on the appeal).

(approx. 43 minute mark) Richard Conlin and Sally Clark discuss the idea of easing the transition between the “Urban Village” and the surrounding single family area, perhaps by changing the zoning of the single family area around the station. There’s also an interesting discussion of the definition of “Urban Village” and “Urban Core” — “it’s a thing.”

(approx. 51 minute mark) Lyle Bicknell describes an idea for collecting community input and making the work plan section of the neighborhood plan. Council members discuss the pros and cons of this new format versus the existing matrix.

Overall, committee members showed interest in supporting the community desires for continuing public input in neighborhood planning and implementation of specific goals.

After the committee meeting, Dennis Saxman approached me to discuss the three appeals to the SE neighborhood plan updates. He mentioned he had helped draft the appeals and stated that there is nothing notable in the appeals being identical.  Saxman also expressed concern about media coverage of the appeals.  (We agreed that comments on some blogs went too far and became personal attacks.)  Saxman is familiar with challenging DPD via the Hearing Examiner’s office, most notably in this case on Capitol Hill.

City Councilmember Mike O’Brien is the SPUNC chairperson. This committee is responsible for legislative matters including:

  • Water, drainage, wastewater and solid waste services provided by Seattle Public Utilities (SPU), including SPU environmental services and utility rates, regional water resources and endangered species recovery plans
  • Neighborhoods, including neighborhood plan updates and implementation

Process, participation, and progress: a neighborhood planning primer

While many people pay a great deal of attention to national politics, relatively few participate (or are even aware) of events happening in their own neighborhood—until issues percolate into the media. Recent events in Southeast Seattle might have caused some neighbors to wonder how the neighborhood planning process works, and what is actually in the North Beacon Hill Neighborhood Plan. Here’s a quick introduction to planning in our neighborhood.

What is a Neighborhood Council?  Why should I get involved?

North Beacon Hill is fortunate to have an engaged neighborhood council and to be part of a dynamic, functional district council. The North Beacon Hill Council describes their role as follows:

“NBHC is one of the the major community groups that represents North Beacon Hill to city, county and state agencies. It is the major political body of the neighborhood that works to improve the living conditions of our neighborhood… We work to empower our neighbors to implement the improvements to the neighborhood that they envision, we work to inform our neighbors of issues that will affect our standard of living, and we work to create a sense of community for our neighborhood.”

If you can make it to one meeting, you’re a voting member of the North Beacon Hill Council.  Attend a meeting to familiarize yourself with the issues and people involved.  If you can’t make it regularly, stay connected and attend when you’re able or when an issue motivates you.  It’s even possible to vote by proxy.  We have the Beacon Hill Blog, the BAN mailing list, and the North Beacon Hill Council website as resources.    Get involved!

Who represents neighborhoods?

There are important connections between neighborhood councils, district councils, and City Council.  Seattle elects City Council members “at large”—all council members represent all residents.  To ensure that residents of all neighborhoods have representation on the community level, Seattle has neighborhood councils—groups that meet in the community and are composed of residents, business owners, and other interested parties.  Residents and members of the councils elect board members.  Council Boards interact with the City and other levels of government, representing the community. The neighborhood councils also elect representatives to a district council. Seattle has 13 district councils.  North and South Beacon Hill are part of the Greater Duwamish District Council. District Council representatives participate in the City Neighborhood Council.

The North Beacon Hill Neighborhood Council and the Greater Duwamish District Council are a key way for our community to engage with City Council members, the Mayor’s office, and other elected officials.  They also advocate for our community to receive funds for sidewalks, crosswalks, greater police engagement, and more.

NBHC meets the first Thursday of every month at the Beacon Hill Library, 2821 Beacon Avenue South. The next meeting is March 4 at 7:00 pm.

What are neighborhood plans? Who develops them?

There has been active debate recently around the three identical appeals filed to oppose Neighborhood Plan Updates in North Beacon Hill, North Rainier (a.k.a. Mount Baker Station), and Othello.  The appeals themselves are intended to address concerns about the environmental impact of development in the area. The appellants and their supporters are also concerned about the process the Department of Planning and Development (DPD) used to create the updates.  This is a separate, but very important issue.

Opinion: It’s about zoning

On Tuesday, February 10, the Hearing Examiner’s Office conducted a prehearing conference regarding the appeal filed by Frederica Merrell to vacate the Determination of Non-Significance (DNS) for the North Beacon Hill Neighborhood Plan update. There was also a prehearing conference for the appeal against the Othello update. The North Rainier (a.k.a. Mount Baker) appeal will be heard by the Hearing Examiner on February 16.

These meetings are the first of many steps to examine the merits of the identical appeals filed by separate individuals against the Neighborhood Plan updates. These meetings are costing City of Seattle taxpayers money and taking staff time away from other DPD business. They are also delaying any progress on the work plans associated with the Neighborhood Plan Updates and halting any development and/or design plans for the sites involved.

El Centro de La Raza has lost $75,000 in funds offered to help them begin preliminary community outreach to discuss design and development ideas for their property. They cannot begin to move forward on developing their site until there is some indication that zoning issues will be resolved. El Centro is a valuable community partner. They would like to develop their property in the best interests of the neighborhood. They cannot begin the conversation about how to do that until the zoning issues are resolved.

Let’s be very clear: the Neighborhood Plan Updates are totally, completely about zoning. The entire point of the Neighborhood Plan Updates—the only reason they were ever developed—was to discuss zoning in the specific areas around the light rail stations. They were not intended to be and will never be replacements for the extensive Neighborhood Plans our communities have in place.

All other issues are red herrings. Concurrency is a completely unrelated issue to the upzone conversation—apples and oranges. The Neighborhood Plan validation process is also completely unrelated—a completely separate process.

This is the core of El Centro’s counter-appeal. DPD can clearly demonstrate that these appeals are too general and many of the complaints are outside the jurisdiction of the Hearing Examiner’s office and outside the scope of the update.

From El Centro’s Motion to Dismiss:

“El Centro de la Raza makes a motion to dismiss this appeal because Ms. Merrell appears to be raising issues related to the passage of the North Beacon Hill Plan, rather than the adequacy of the City’s environmental review. The North Beacon Hill Plan has not been adopted by the City Council yet. No changes to the Comprehensive Plan, nor to the zoning code, have yet occurred. Therefore, any issues related to the North Beacon Hill Plan itself, or related to any potential future zoning change, are not ripe for the Hearing Examiner’s review. In addition, any issues related to the Growth Management Act are not properly before the Hearing Examiner and must be dismissed.

In the alternative, El Centro suggests to the Hearing Examiner that the appeal is essentially limited to a single legal issue: whether the City properly exercised its discretion under WAC 197-11-055, 197-11-060, and 197-11-228 to complete proper environmental review of comprehensive planning documents. We ask that the Hearing Examiner dismiss all other issues raised by Ms. Merrell, as such claims are related to the unadopted plan or possible future zone changes. ”

Unfortunately, it’s going to take weeks (if not months) of public employee time away from actual projects to address these appeals. These appeals are an expensive time-wasting strategy with an end goal of keeping things in limbo.

Development will happen, but it’s going to take years and millions of dollars longer because a very simple zoning question—one that has received a significant amount of community feedback—is not being answered. That’s a shame.

Walking with Tica: Andy Rooney edition

Hey Beacon Hill drivers: what’s the rush? I’ve been walking these streets for six years, enjoying the peaceful community, friendly neighbors, and quiet streets. Something changed lately… the streets are not as quiet.  Maybe the construction traffic for Sound Transit slowed traffic on McClellan, and now people are back to their Speed Racer habits.  It’s not just arterials, though.  Folks are flying down side streets, too.  My older dog and increasing belly are slow—is there some reason we should hurry?

Is your kid late enough to school that you need to rush a pregnant woman crossing 23rd? Did you forget to Tivo your soap opera, making it necessary to drive 40mph down 20th, narrowly avoiding parked cars and cats dashing across the street?  Is there any reason you absolutely must turn right on red as that senior citizen loaded with groceries is making his way across Beacon?

Unless you have flashing lights to go on top of your car or are driving someone to the hospital—SLOW DOWN!  Per SDOT: In Seattle, the speed limit on residential streets is 25 mph and 30 mph on arterial streets unless otherwise posted. Drivers are expected to know and obey the speed limit.

Pedestrians (and our pooches, strollers, toddlers) have right of way. Stop, look, and wait for pedestrians at intersections. Perhaps you could use that 20 seconds to meditate… or maybe you could hang up your cell phone, put down your sandwich, and remember that you’re in a metal cage capable of killing someone.
