Analysis: Neighborhood action plan still lacks clarity

The Department of Planning and Development (DPD) has introduced legislation to the City Council for adoption of our neighborhood plan update in Councilperson Mike O’Brien’s committee next Tuesday, September 28. You can download the Action Plan PDF file here. In the past week, they have finally put in all the details that people have been asking to see. Don’t blink, you will miss it!

For comparison, here is the matrix of projects voted on at the Beacon Hill Festival (only the ones that received an average support rating of 2 or higher). Many great ideas are not included in the DPD update.

DPD actions are phased as: o for on-going, p for planning, u for underway, or d for done. There are lots of blanks where they don’t know which phase we are in. I have to wonder why we are getting “done” projects in our action matrix for a ten-year plan for the future? I guess we need a little padding in a few spots! Here is my educated review of the Action Plan:

Goals #1, 2, and 3. DPD has put a lot of emphasis on developing low-income housing. DPD again claims to be developing an urban design framework for us, but I still don’t know what that means. Clearly zoning and land use is DPD’s main interest and expertise area. (It doesn’t hurt that every development project that gets permitted puts money in the department coffers.)

All the actions under the first three goals (housing and commercial district development) are on-going or planned. There is one interesting exception: Resolving litter issues in the town center is listed as done! I am not sure how that has manifested in our town center, exactly.

There are no housing goals, nor is there acknowledgement of the huge amount of multi-family housing going in at the north end of the hill. Rating: OK but incomplete for rest of neighborhood and maybe a little inaccurate on the litter front.

It starts to get weird under Goal 4: Parks and Open Space. They have only two policies: Preserve and support El Centro, and Seek Small Pocket Parks. There is emphasis on the El Centro Civic Gathering Space, an indoor facility, I believe (see Goal 6). The only actions with a planning designation are El Centro’s civic gathering space, El Centro’s children’s play area and an urban design framework element for Jose Rizal Park. In spite of the fact that eight different proposals for open space were submitted to the Parks Opportunity Fund this year, the only one acknowledged by DPD is the El Centro Children’s Play Area project. What about the other five: Lewis Park, North Beacon Central Park, Walker Street, 12th Street View Spot, and the Gatehouse project at Jefferson Park?

DPD pads this section with completed or almost completed projects. Beacon Hill Playground project is listed three times and is already underway, probably to be finished before the end of the year. Under Jefferson Park Master Plan, a small number of projects are underway or done. Why is “recommission the South Reservoir” in there as an action? It was completed over a year ago!

Opinion: Save the Jefferson Park Gatehouse

The gatehouse at Jefferson Park is in imminent danger of destruction. After twelve years of neighborhood planning with the gatehouse in multiple versions of the Jefferson Park plan, Seattle Public Utilities (SPU) and the Seattle Parks Department (DPR), suddenly announced they decided to “demolish the gatehouse,” just months before the grand opening. What happened?

This story is a textbook example of the worst result that can occur when SPU and Parks fail to work together.

Falling through the cracks of bureaucracy

In 2002, just after the first year-long Project Advisory Team (PAT) meetings ended, SPU began a demolition permit for the old reservoirs. Unknown to the PAT or the community, the gatehouse was part of that permit because SPU thought there might be a possibility it would need to be removed along with the reservoirs. At the same time, SPU submitted a draft landmark nomination for the gatehouse to the landmarks board in preparation for the possible demolition.

Meanwhile, the neighborhood and city continued planning Jefferson Park. In 2005-2006, there was another year long PAT. The 2006 plan shows the gatehouse restored as restrooms with a “gatehouse plaza” in front. The plan also called for the removal of the obscuring trees on the west side. Parks still has not removed those trees, making it nearly impossible to see the building. The community, the ProParks levy oversight committee, the board of Park commissioners, the mayor and the city council all reviewed and approved the 2006 plan. This is the plan Seattle voters gave fifteen million dollars to plan and build through two parks levies.

As construction began, Parks determined it would be impractical to convert the gatehouse into restrooms. As a result, the budget for the gatehouse went elsewhere. SPU avoided demolition. When SPU asked Parks if they wanted the gatehouse, Parks responded, “As stated at the meeting, Parks is not interested in taking over the building and utilizing it for any purpose.” (6/15/2009)

This left SPU with a dilemma. The gatehouse served Seattle’s water system from 1910 up until 2007 when it was decommissioned. SPU says that it cannot spend public money on the gatehouse because it is no longer a functioning part of Seattle’s’ water system. SPU insists Parks’ decision to abandon the gatehouse leaves SPU with no alternative but demolition. Parks, on the other hand, claims to have no money left out of the fifteen million they were given to save and maintain this tiny building with a century of Beacon Hill and Jefferson Park history in its walls.

Gatehouse history

The year is 1910. Seattle is reveling in an amazing feat of engineering known as the Cedar River Watershed and Pipeline, ending at the reservoirs in Jefferson Park. The gatehouse controlled the flow of the reservoirs to the city. The man behind the drive that got the job done was Reginald Heber Thomson, chief engineer for the city of Seattle. He overcame tremendous physical and political barriers to accomplish what many before him tried and failed: to build Seattle a safe, clean, and secure drinking water supply. Finally, Seattle would be a modern city and would no longer have to drink the “turbid waters of Lake Washington” (“Shaper of Seattle: Reginald Heber Thompson’s Pacific Northwest,” William H. Wilson 2009).

Historical research shows the name of Mr. Thomson appears on the final drawing for the gatehouse (Landscape Inventory of Jefferson Park, Historical Research Associates [HRA] 2001). The draft landmark nomination submitted by SPU (SPU/Sheridan Associates) in 2002 also notes that the name of R.H. Thomson is on the final drawings for the gatehouse. The recent landmark nomination from SPU makes no mention of Mr. Thomson’s name. They simply state it was designed by “Seattle Water Department staff”. The construction drawing in the SPU nomination does not show his name.

At the same time, a revolution in landscape design and urban planning known as the “Beautiful Cities Movement” had reached its peak with Daniel Burnham’s epic “Plan of Chicago,” released in 1909. Cities all over the world were clamoring to plan their own beautiful cities, inspired by the vision put forth in Chicago. Seattle hired the Olmsted brothers design firm to plan Seattle’s park system. The preliminary plan for Jefferson Park was done in 1912. John C. Olmsted surveyed the site in 1903 in preparation for the 1912 planning. He remarked on the extraordinary views and prepared for a design that would incorporate the reservoirs into the overall park plan. Most of the plan was never realized; only the 18-hole golf course and the gatehouse remain from this earliest period in the development of Jefferson Park. The views remain as spectacular as ever.

Gatehouse future

The elimination of the restroom conversion idea left the gatehouse without a function. Parks toyed with the idea of turning it into a maintenance shed, but that would require cutting a giant hole in the side for the installation of a roll up door. They simply had no better ideas and decided to abandon it instead.

“The Jefferson Park Gatehouse and History Plaza” is a project under review by the ProParks levy oversight committee’s “Opportunity Fund” program. This project idea proposes to use the gatehouse as a history display plaza and water resource education facility. This will be a complement to the water resource education theme of the soon to be built beacon mountain playground. the project is up against many other creative ideas competing for limited funds. there is no guarantee the history plaza idea will make it now, but that does not mean it could not be funded by other means at a later date.

The money

SPU released three different options with cost estimates for the gatehouse.

  1. Repair, Secure, and Maintain: $232,000. This will restore the building to a condition safe for use by the public.
  2. Mothball: $124,300. This will make the building safe, though not suitable for active use-just basic repairs.
  3. Deconstruction: $177,665. This is SPU and Parks’ preferred option. It will wipe out all traces of the gatehouse and the history it represents, except for a couple of the antique valves Parks says they will display on a concrete pad where the gatehouse once stood, as an “artifact” of the reservoirs.

As the estimates show, the cost to save this building in the short term by mothballing it is the cheapest route. It costs less to save the gatehouse than it does to destroy it.

How to save the gatehouse

This building does not deserve to die because of a lack of interest or concern on the part of the city employees we depend upon to implement Seattle’s neighborhood plans. The Jefferson Park gatehouse and the history it continues to represent belongs to the people of Seattle and Beacon Hill. It represents a direct connection to the past that shows Seattle once planned a great Olmsted Park for Beacon Hill. It took one hundred years to get us there, but now that vision has finally arrived, and Beacon Hill is going to get that “beautiful cities” park planned so long ago. Let’s not begin the next 100 years of history at Jefferson Park by erasing the only element left that links us to the last 100 years.

It is not necessary to landmark the gatehouse in order to save it. SPU and DPR need the landmarks board to declare the gatehouse ineligible for landmark status to begin deconstruction. It is absolutely necessary that Beacon Hill speak out now in support of the gatehouse in order to save it.

Here’s what everyone can do:

  1. Contact SPU (ray.hoffman@seattle.gov) and ask them to stop the demolition plans and withdraw the permit, regardless of the decision made by the landmarks board.
  2. Contact the Seattle Parks Department (christopher.williams@seattle.gov) and ask them to stick to the plan, accept responsibility for the gatehouse, and cut down the trees as planned so everyone can see the building.
  3. Contact the Chair of the City Council Parks committee, Sally Bagshaw (sally.bagshaw@seattle.gov), and the other city council members (tim.burgess@seattle.gov, sally.clark@seattle.gov, richard.conlin@seattle.gov, jean.godden@seattle.gov, bruce.harrell@seattle.gov, mike.obrien@seattle.gov, nick.licata@seattle.gov, tom.rasmussen@seattle.gov) and tell them Beacon Hill wants to see the gatehouse saved in the short term, and restored in the long term.
  4. Contact Mayor McGinn (mike.mcginn@seattle.gov) and ask him to save the gatehouse and tell SPU and Parks to stick to the neighborhood plan.
  5. Contact the Landmarks Preservation Board (beth.chave@seattle.gov) and tell them you want to see the gatehouse landmarked and preserved.
  6. Attend and testify at the Landmarks Preservation Board meeting on Wednesday, September 1, at 3:30 pm in the Seattle Municipal Tower, 700 Fifth Avenue, 40th floor, room 4060.
  7. Contact the Levy Oversight committee (susan.golub@seattle.gov) and ask them to fund the restoration of the gatehouse via the Opportunity fund .

The vision we see emerging at Jefferson Park is the direct result of Beacon Hill residents’ unwavering support for their neighborhood plan. The gatehouse is key to that vision. For the first time in 100 years, Beacon Hill can see a future with an Olmsted Park, the way it was meant to be. If you ever wrote or called in support of Jefferson Park in the past, now is the time to do so again. If you never got involved before, now is your chance to make a difference.

There is only one Jefferson Park Gatehouse. Now is the time to save it and the history it represents – for the next 100 years.

Walking with Tica (and now Sylvia): Thanks, neighbors!

Tica’s walks are a little slower and a little shorter than they used to be. She also has to share the smiles and praise our neighbors generously dole out. On May 14, we added a third person to our family: Sylvia Grace Foster. Gifts and well wishes started arriving before we even brought her home, thanks to the “doggy grapevine.” The neighbors who walked Tica while Sylvia was being born shared the news of her birth with all our doggy friends. We arrived home to a warm welcome!

Sylvia is napping in one of the many adorable outfits Heather passed down from her kids. I’m enjoying a hot bowl of chicken vegetable soup while the baby sleeps—courtesy of our neighbor Georgia. Judith’s potato soup waits in the freezer for another cool day; I devoured the chicken rice ambrosia as soon as she left it on the porch. Other neighbors have shared gifts, food, support, and tips for raising a baby in Beacon Hill—thanks to you all!

Beacon Hill businesses have also been welcoming, generous, and patient with our new baby. Sylvia’s first outing was to the newly opened The Station, where Luis greeted her like family. We strolled to the Beacon Hill Festival and had lunch afterwards at Baja Bistro and dinner a few days later at La Cabaña (impossible to say which is more family/baby friendly).  Already, we’ve enjoyed two Beacon Rocks! events, visited the library multiple times, and been granted the royal treatment at Red Apple. Sylvia ogles other babies smaller than watermelons at McPherson’s, and enjoys attention from the big kids in strollers at Beacon Hill Office and Mail Center.  I’m looking forward to seeing everyone at the Piñata Party next Saturday!

Many thanks to all the wonderful, amazing, generous, thoughtful people who have welcoming Sylvia to Beacon Hill.  I hope she always appreciates how fortunate we are to live in this community.

Opinion: Alley speeders need to slow down

I live on 14th and South Hinds Street, an area right by the freeway exit. People often drive very fast on this almost one-lane neighborhood street, in order to cut down to the freeway (thus bypassing 15th and therefore saving seconds of time). Since we don’t have sidewalks, and the road has two curves, it is very dangerous—poor visibility, and literally nowhere for pedestrians to go.

When even this shortcut takes too long, they also often bypass even 14th/South Hinds Street, and instead cut at high speeds through my alley. This is even worse, since it’s very narrow and abuts right next to all property—and of course, no alley sidewalks as well.

A few days ago, I was walking in the alley to my house (I take the alley due to lack of street sidewalks) when a man, smoking and driving a silver Lexus SUV, sped towards me up the alley from the freeway. Please keep in mind that I am very obviously pregnant, which makes me slower than normal. Regardless, apparently this short pregnant pedestrian didn’t move out of “his” way fast enough, so, barely stopping, he rolled his window down and shouted “this road is for cars.” No sir, it is not. It is an alley. It is for property access. There are actual roads to the left and right of this alley. This kind of thing is, unfortunately, common.

I feel this is very unsafe but don’t know what to do. My dream would involve a speedbump or two in the alley to prevent speeding impolite people shaving off fractions of a second of their drive by taking the alley instead of a road, and sidewalks on the curved stretch of South Hinds Street.

(Anyone have any advice for Jennifer? We suggested that she check out the SDOT Neighborhood Traffic Operations: Traffic Calming Program website, but we hope some of you have better advice.)

Opinion: Pedestrian crossing at Beacon and Lander demands attention

Since the light rail station opened last summer, the crosswalk at Beacon and Lander has become the busiest on Beacon Hill. The majority of the people exiting the station are headed west to go to the bank, Red Apple, the southbound bus stop, or home. All of these people must cross Beacon, and many get very creative in the process. Because the crossing is way out at the corner and runs diagonally to the corner away from Red Apple and the bus stop, many people choose to just cross through the middle of the street. Because the crosswalk—which now has flashing beacons and signage, but once only had markings on the pavement—is at the intersection with Lander, there is not only north-south traffic moving through but also people turning onto Beacon from Lander. With the long crossing, the multitude of car approaches, and the scurrying light rail riders, it is ripe for an accident.

The other day I camped out at the crosswalk from 5:00-6:00 pm and filmed about 16 pedestrian crossings when cars were around. I put them together and, with very little editing, made this video:

This was not a “best of” video, but simply what you see at every rush hour here. After bemoaning the miserable state of our most popular Beacon crossing, I started to think about how the pedestrian infrastructure at all the other light rail stations in Seattle seemed satisfactory and even exemplary. Yesterday I decided to take a ride on the light rail and check out each station and then do a little compare and contrast with what we have been dealt. The results from this foray are here:

Apparently Sound Transit is only responsible for putting things back the way they found them, and Seattle’s Complete Streets Ordinance—which requires attention to pedestrian safety among other things—does not apply to them when they do their repave this summer. The Seattle Department of Transportation (SDOT) has been working with Beacon BIKES! to improve this crossing, but they have limited funds. I am suggesting that Sound Transit work with us and SDOT to improve this crossing as part of the repave this summer. Walking with Tica: Growing community

When I was cruising the internet 10 years ago searching for the perfect canine companion, I looked forward to having a fuzzy head keep my feet warm on the couch and planned the cool tricks I would teach my new pal. I also started jogging a few weeks in advance, so that I would be in better shape to tire out an energetic young dog (ha!).  I researched food, off-leash areas, doggy daycares and dog walkers.

What I didn’t realize was that over the years, I would get to know every tree and front flower garden in the neighborhood.  I’ve learned where the dogs live and where the cats like to hide.  While Tica sniffs, I read the “for sale” and “lost bike” signs on the telephone poles.  We’ve watched babies grow into kindergardeners. Walking with Tica has shaped the way I interact with my community.

I enjoy casual (and sometimes lengthier) conversations with neighbors—mostly those who spend a lot of time outside, like the dog owners and avid gardeners. Walking with a dog provides an opening for conversation, sort of a secret handshake.  People stop and smile and start conversations.  People reach into their pockets (or go into their houses) to share a treat with Tica.  We exchange cookies during the holidays and keep an eye on each other’s homes on vacation.

It shouldn’t have surprised me that growing a baby brings out the same responses in people.  I’m getting to know an entirely different group of neighbors—the grandmas, the moms without dogs, older kids who feel safe making eye contact with a mom-to-be.  The always friendly library staff and Red Apple cashiers are absolutely bubbly.  People who usually walk quickly from their car to the front door linger on the sidewalk to say hello, ask how I’m doing, or offer baby items.  I’m amazed by the generosity of our neighborhood.  Thank you to all the neighbors who’ve shared baby items, support, and yummy snacks!

Have you ever searched “Beacon Hill” on craigslist?  I’ve gotten several baby items in perfect condition at a great price. Best of all, I got to meet new neighbors with kids, within walking distance of home!

If you’d like to donate children’s items or know a family in need, Wellspring Family Services operates the Baby Boutique.   Their “urgent needs” wishlist includes: carseats, maternity clothes, shoes, and personal care items (shampoo, lotion, etc).  The Baby Boutique serves kids of all ages, from newborn to teenager.  Baby Boutique accepts donations on the following days and times: Tuesday 10:00 am – 7:00 pm; Wednesday thru Friday 10:00 am – 3:00 pm; 2nd and 4th Saturday of the month 10:00 am – 2:00 pm; or call 206-902-4270 to set up an appointment. Due to limited space, they cannot accept items larger than cribs or toddler beds.

I’m just getting started with the North Beacon Hill Parents yahoo group.  It seems to be a good place to give away/sell kid items and post questions about everything from preschools to replacing old wood windows. I’m looking forward to interacting more with this group.

Opinion: Beacon Hill vs. Georgetown

All of this recent rezoning talk has gotten me thinking about North Beacon Hill’s business district. I’ve lived in many different areas of Seattle and although I love Beacon Hill, I can’t quite put my finger on what it is that does not work with our business areas. I love our coffee shops, funky grocery stores, and ethnic restaurants and I do my part to make sure that I spend money locally, but why do I so often find myself leaving the hill for other services? Some of the answer is obvious: when I want to go see a movie I head over to Columbia City Cinema or the Admiral Theater, since this is a service that I just can’t get in our neighborhood. But I also find myself going to Georgetown just to eat dinner or grab a beer after work. If you have been paying any attention you will have noticed that Georgetown has been booming for the last ten years, with many new restaurants and shops and just funky things going on. What do they have that we don’t?

First I decided I should look at available data to see if I could find some truths. According to Zillow.com, Beacon Hill has 4104 residences, our median income is $45,965 (above Seattle’s median income), our highest percentage age group is people in their 30s, and our average household size is 3.107 people. Add to this mix an awesome underground light rail station, stunning views, a large brand-new park coming soon, convenient freeway access, and a location that is a stone’s throw from downtown, and Beacon Hill has been dealt a winning hand.

Now let’s take a minute to look at Georgetown. If you can dodge that freight train and try to concentrate over that low flying plane noise for a minute, let’s try to take a look at their numbers. Depending on where you draw the line, Georgetown has a mere 379 residences, their median income is $33,654 (almost the lowest in Seattle), their highest percentage age group is people in their 20s, and their average household size is 1.94. Add to this mix a few Superfund sites, eclectic zoning, and some disjointed industrial areas, and it’s a wonder that Georgetown survives at all. Despite all of this, Georgetown is not only surviving, but thriving. Their vibrant business district has added new bars and restaurants almost yearly, and their events such as Artopia attract people from all over the region. Music stores, bakeries, multiple coffee shops, pet supplies, a beer store and antique stores have all opened in the last few years.

The Seattle Office of Economic Development (OED) recently released a study focused on retail in Rainier Valley. Although the study didn’t focus on Beacon Hill, one of the study’s main finds was “leakage,” which is roughly defined as people leaving their own neighborhoods to buy products and services in other areas. Just as Beacon Hill clearly suffers from leakage as many people leave the area for basic services, neighborhoods such as Georgetown clearly capitalize on this, since there is no way that the 379 people that live there could possibly support their range of businesses.

It’s hard not to conclude from this data that zoning alone will not fix our business district. Neighborhoods like Georgetown and Columbia City have certain less-measurable qualities about them that have helped them thrive. Chief among them has to be neighborhood pride, creativity, activism, long-term vision, building owners willing to take chances, investors with vision and tough as nails entrepreneurs that are brave enough to swim against our economic current. None of these are qualities that we can zone for; they are qualities that we must earn with a lot of difficult risk, vision, community participation, cooperation and tenacity.

Opinion: The appeal process and not showing your hand

There has been significant interest in the appeal that I filed with the Hearing Examiner’s office on January 29. I love that people in our community are engaged, reading, and looking at what is going on around them. Our Beacon blog is an amazing venue for keeping up on stuff that’s important to us and not likely to be followed anywhere else.

An appeal is a quasi-judicial process with rules and procedures. The Hearing Examiner runs the show and our examiner Sue Tanner is very capable and experienced. She is charged with impartiality, efficiency, expediency, transparency and equal access to all, even those without a lawyer or legal training (like me). There are lots of areas where appeals are used, including the appeal of an environmental determination (SEPA appeal) like mine.

So there is the person filing the appeal (me), the agency or party whose action triggered the appeal (the city’s Department of Planning and Development, or DPD) and the Hearing Examiner. Other people can enter into the discussion too, and anyone can come watch any step of the process down at the Hearing Examiner’s office on the 40th floor of the big tower at 700 Fifth Avenue (Seattle Municipal Tower). I assume the records on the process are all open to the public.

Last week, I had my Prehearing Conference. This is a time to meet, go over the paperwork that is being filed, make sure everyone has each other’s addresses, and create a mutually agreeable calendar for the steps being taken. I noticed that most of the time was taken up with the calendar. In order to do the calendar all the likely steps in the process have to be laid out. Right now, DPD is going to find some information for me and also try to narrow the scope of the appeal. They felt it was too broad. I will get some time to look at the information they provide and respond back. We will both draw up a list of “exhibits” that we want to share with each other in the hearing. We will both draw up a list of “witnesses.” The time frame for all these steps are laid out and we came to agreement on a hearing date of April 7 at 9:00 am. Anyone who wants to watch the hearing can come.

The excellent media folks at our blog asked me some specific questions about the appeal. An appeal is kind of like a poker game. One important strategy for winning the game is not showing your hand. So I’m not going to answer a lot of specific questions right now while I am in the middle of the process because I want to win my hearing determination! I do encourage you to read information that is readily available. If you haven’t read the full appendix of the North Beacon Hill Update, you might want to do that.

Some other great stuff to look at: check out City Council committee meetings on a good computer where you can see the videos. I recommend the last couple of meetings of Councilmember O’Brien’s Seattle Public Utilities and Neighborhoods Committee (SPUNC) and Sally Clark’s Committee on the Built Environment. Her last meeting was particularly interesting and I am going to go back and look at the whole thing again. This is a very interesting process to me because I have never filed an appeal before. I am learning as I go. If you want to know why I filed the appeal, come to the hearing! That is where I lay out my arguments before the Hearing Examiner and DPD makes their arguments too. Opinion: It’s about zoning

On Tuesday, February 10, the Hearing Examiner’s Office conducted a prehearing conference regarding the appeal filed by Frederica Merrell to vacate the Determination of Non-Significance (DNS) for the North Beacon Hill Neighborhood Plan update. There was also a prehearing conference for the appeal against the Othello update. The North Rainier (a.k.a. Mount Baker) appeal will be heard by the Hearing Examiner on February 16.

These meetings are the first of many steps to examine the merits of the identical appeals filed by separate individuals against the Neighborhood Plan updates. These meetings are costing City of Seattle taxpayers money and taking staff time away from other DPD business. They are also delaying any progress on the work plans associated with the Neighborhood Plan Updates and halting any development and/or design plans for the sites involved.

El Centro de La Raza has lost $75,000 in funds offered to help them begin preliminary community outreach to discuss design and development ideas for their property. They cannot begin to move forward on developing their site until there is some indication that zoning issues will be resolved. El Centro is a valuable community partner. They would like to develop their property in the best interests of the neighborhood. They cannot begin the conversation about how to do that until the zoning issues are resolved.

Let’s be very clear: the Neighborhood Plan Updates are totally, completely about zoning. The entire point of the Neighborhood Plan Updates—the only reason they were ever developed—was to discuss zoning in the specific areas around the light rail stations. They were not intended to be and will never be replacements for the extensive Neighborhood Plans our communities have in place.

All other issues are red herrings. Concurrency is a completely unrelated issue to the upzone conversation—apples and oranges. The Neighborhood Plan validation process is also completely unrelated—a completely separate process.

This is the core of El Centro’s counter-appeal. DPD can clearly demonstrate that these appeals are too general and many of the complaints are outside the jurisdiction of the Hearing Examiner’s office and outside the scope of the update.

From El Centro’s Motion to Dismiss:

“El Centro de la Raza makes a motion to dismiss this appeal because Ms. Merrell appears to be raising issues related to the passage of the North Beacon Hill Plan, rather than the adequacy of the City’s environmental review. The North Beacon Hill Plan has not been adopted by the City Council yet. No changes to the Comprehensive Plan, nor to the zoning code, have yet occurred. Therefore, any issues related to the North Beacon Hill Plan itself, or related to any potential future zoning change, are not ripe for the Hearing Examiner’s review. In addition, any issues related to the Growth Management Act are not properly before the Hearing Examiner and must be dismissed.

In the alternative, El Centro suggests to the Hearing Examiner that the appeal is essentially limited to a single legal issue: whether the City properly exercised its discretion under WAC 197-11-055, 197-11-060, and 197-11-228 to complete proper environmental review of comprehensive planning documents. We ask that the Hearing Examiner dismiss all other issues raised by Ms. Merrell, as such claims are related to the unadopted plan or possible future zone changes. ”

Unfortunately, it’s going to take weeks (if not months) of public employee time away from actual projects to address these appeals. These appeals are an expensive time-wasting strategy with an end goal of keeping things in limbo.

Development will happen, but it’s going to take years and millions of dollars longer because a very simple zoning question—one that has received a significant amount of community feedback—is not being answered. That’s a shame.

Walking with Tica: Andy Rooney edition

Hey Beacon Hill drivers: what’s the rush? I’ve been walking these streets for six years, enjoying the peaceful community, friendly neighbors, and quiet streets. Something changed lately… the streets are not as quiet.  Maybe the construction traffic for Sound Transit slowed traffic on McClellan, and now people are back to their Speed Racer habits.  It’s not just arterials, though.  Folks are flying down side streets, too.  My older dog and increasing belly are slow—is there some reason we should hurry?

Is your kid late enough to school that you need to rush a pregnant woman crossing 23rd? Did you forget to Tivo your soap opera, making it necessary to drive 40mph down 20th, narrowly avoiding parked cars and cats dashing across the street?  Is there any reason you absolutely must turn right on red as that senior citizen loaded with groceries is making his way across Beacon?

Unless you have flashing lights to go on top of your car or are driving someone to the hospital—SLOW DOWN!  Per SDOT: In Seattle, the speed limit on residential streets is 25 mph and 30 mph on arterial streets unless otherwise posted. Drivers are expected to know and obey the speed limit.

Pedestrians (and our pooches, strollers, toddlers) have right of way. Stop, look, and wait for pedestrians at intersections. Perhaps you could use that 20 seconds to meditate… or maybe you could hang up your cell phone, put down your sandwich, and remember that you’re in a metal cage capable of killing someone.
